Nueva York, EEUU.- El actor Cuba Gooding Jr. ha evitado comparecer este martes en un tribunal federal de Manhattan por una demanda civil interpuesta por una mujer que le acusa de haberla violado en un hotel de Nueva York en 2013. El protagonista de Jerry Maguire, ganador de un Oscar en 1996, había insistido a través de sus abogados en que su encuentro con la mujer fue consentido.
El juicio, por la vía civil, iba a comenzar con la selección del jurado en el tribunal, y de hecho sus miembros empezaron a reunirse en la sala minutos antes de que una anotación en el acta oficial del tribunal informase a las 10.24 de la anulación del juicio, por “consentimiento [dado que] las partes han resuelto el asunto”, aunque se desconocen los detalles del acuerdo extrajudicial.
La mujer había procedido de forma anónima hasta la semana pasada, cuando el juez Paul A. Crotty dictaminó que tendría que revelar su nombre en el juicio; el sumario se refería a ella con el genérico Jane Doe que consagra el anonimato de demandantes o testigos de sexo femenino. Según la demanda, conoció a Cuba Gooding Jr. en un restaurante de Manhattan, y este la convenció para que se reuniera con él en un hotel y le esperara en su habitación mientras él se cambiaba de ropa. Los abogados del actor, sin embargo, añaden no sólo que la relación fuera supuestamente consentida, sino el hecho de que ella presumiera después ante otras personas de su intimidad con una celebridad.
La demandante solicitaba seis millones de dólares por daños y perjuicios a un hombre que, según las autoridades, ha sido acusado de comportamiento sexual inapropiado por más de 30 mujeres, incluyendo manoseos, besos forzados y otras conductas abusivas. De hecho, el viernes pasado, el juez Crotty pareció reforzar la posición de la mujer en el juicio y en las negociaciones para llegar a un acuerdo, al decidir que permitiría a otras tres mujeres declarar que también fueron objeto de abusos sexuales o intentos de agresión sexual después de conocer a Gooding en entornos sociales como festivales, bares, clubes nocturnos y restaurantes. El magistrado desautorizó el testimonio de una cuarta mujer, que acusa al actor de haberle manoseado el pecho, por redundante.
A Gooding, muy popular en los años noventa gracias a películas como Boyz n the Hood (Los colegas del barrio, en España) y Radio, se le permitió declararse culpable en abril de 2022 de un delito menor en otro caso, admitiendo que besó por la fuerza a una trabajadora en un club nocturno de Nueva York en 2018. Tras seis meses de rehabilitación conductual y del consumo de alcohol, Gooding retiró entonces su inicial declaración de culpabilidad y en su lugar se declaró culpable de ese delito menor, lo que eliminó sus antecedentes penales y evitó nuevas sanciones.
Como en el caso del expresidente Donald Trump, condenado el mes pasado a indemnizar con cinco millones de dólares a una mujer por abuso sexual y difamación, la vía civil del proceso contra Cuba Gooding Jr. no iba a resultar en una pena de cárcel, sino únicamente en una compensación monetaria. Las perspectivas de un acuerdo, que con frecuencia evita llegar al juicio en casos civiles, parecían sin embargo escasas el jueves pasado por las profundas diferencias entre los litigantes.
